I agree that there is more to consider than pricing when it comes to creating a sustainable, innovative practice in this economy. However, I do not think that law school debt should stop young and innovative lawyers from setting up alternative practices. With federal consolidation options and the ability to defer payments for the first few years, young lawyers can focus on establishing a viable practice without paying thousand dollar monthly payments on loans.

I also agree with Misty, the legal profession needs to progress from a focus on getting rich to a focus on helping people. As I once heard Jay Foonberg say: when you focus on helping people, the money follows.

Jay,

Thanks for visiting. I don't disagree with you at all. Pricing is but one component of designing a practice from the ground up. And without fail the practices which will survive will be those which provide that which only trained lawyers can provide as articulated by Marc.

As long as recent grads and early-career lawyers are encumbered with servicing staggering debt, they will never be able to effectively compete on price in categories where they compete against non-lawyer providers.

I think the challenge is more fundamental -- and radical -- than pricing. It will entail designing practices around services that intrinsically consitute the practice of law, where non-lawyer service providers cannot compete.

As Marc noted in his comment on one of my recent blog posts, "Hard to say what is ‘intrinsically legal work,’ but candidates usually involve at least one of the three A’s (activities – advice, analysis, advocacy) and one of the three D’s (deliverables – decisions, deals, documents) in the context of expertise and trust."

The new legal market is stretching legal professionals in a healthy way. I love seeing the innovative ways attorneys are cutting costs and becoming more client focused. I believe these innovators will change the way the business side of law is carried out. A great byproduct will be that the reputation of the legal profession will improve.
